The 2014 Report of the Legal Commission on Marital Property accepted the decision in cyclists in general and recommended the creation by Parliament of a “qualifying marriage agreement” that would create a fully binding pre-marital agreement as long as certain requirements were met. The Commission`s recommendations have yet to be implemented. In several European countries such as France, Belgium, the Netherlands, Germany, Poland, Switzerland, Sweden, Denmark, Norway and Finland, marriage agreements have long been considered valid. While in some of these countries, limits apply to restrictions enforceable or valid by the courts (for example. B Germany after 2001, when the appelncies courts indicated it), a written and duly initiated contract, which was freely concluded, cannot be challenged, for example by arguing the circumstances in which the marriage broke down or where the marriage reigned. In France and Belgium (as in Quebec, which has the same judicial tradition), marital agreements must be concluded in the presence of a notary. Marital conventions are civil, so Catholic canon law does not exclude them in principle (for example. B to determine how property is distributed among children in a previous marriage after the death of a spouse). The courts will not require a person to do all the housework or to have the children raised in a particular religion.
 In recent years, some couples have included social media provisions in their marriage contracts and have set rules on what can be posted on social media during the marriage, and in case the marriage is dissolved.  The marriage contract may be entered into by a woman and a man who have applied for registration of their marriage, as well as by spouses. Minors who wish to enter into a marriage contract before the marriage is registered must obtain consent from their parent or administrator, authenticated by a notary. In India, marital agreements are very rare and have no laws in force. However, in the face of rising divorce rates, there is a growing interest in them. Some legal experts believe that prenups have no legal sanctity in India. However, in some cases, usually among wealthy citizens, a form of contract is signed. But agreements must be reasonable and not violate existing laws, such as the Hindu Marriage Act. Indian courts allow for the signing of a settlement protocol during divorces. But no court has yet been asked to impose a prenup.  In Judaism, the Ketubah, a marriage contract, has long been established as an integral part of Jewish marriage and is signed and read at the wedding.
It contains the man`s requirement to support his wife by providing her with food, clothing and sexual intercourse and provides for the wife`s support in the event of divorce or death of her husband. Under this passage, however, a woman can walk if her husband does not take care of her. The laws differ between the two states and the countries, both in terms of the content they may contain and the conditions and circumstances under which a conjugal agreement can be declared unenforceable, such as. For example, an agreement signed in cases of fraud, coercion or adequate disclosure of assets. You will find these conditions in Article 1466 of Thailand`s Commercial and Civil Code. In accordance with Thai marriage laws, the matrimonial agreement focuses on the assets and financial consequences of marriage and sets the terms of ownership and management of common personal and concrete property and the eventual division of marital property when the marriage is dissolved.
